By using TradiesHub Fiji, you acknowledge and agree to these terms. TradiesHub Fiji is a MARKETPLACE PLATFORM ONLY and accepts NO LIABILITY for work performed by independent contractors.

Platform Role & Limitations

TradiesHub Fiji IS:
  • An online marketplace platform connecting customers with independent contractors
  • A technology service provider facilitating introductions
  • A communication and payment processing facilitator
TradiesHub Fiji IS NOT:
  • An employer of any tradesperson or contractor
  • Responsible for the quality, completion, or safety of any work performed
  • A construction company, contractor, or service provider
  • An insurer or guarantor of any services
  • A mediator or arbitrator of disputes between parties

LIABILITY DISCLAIMERS & LIMITATIONS

COMPLETE DISCLAIMER OF LIABILITY

TradiesHub Fiji, its owners, directors, employees, and affiliates SHALL NOT BE LIABLE under any circumstances for:

Work-Related Issues:
  • Poor quality workmanship
  • Incomplete or abandoned projects
  • Property damage during work
  • Personal injury on work sites
  • Code violations or permit issues
  • Warranty or guarantee breaches
Contractor Issues:
  • Unlicensed or unqualified contractors
  • Fraudulent or dishonest behavior
  • Theft or criminal activity
  • Insurance coverage gaps
  • Payment disputes or non-payment
  • Breach of contract by contractors
MAXIMUM LIABILITY LIMITATION

In no event shall TradiesHub Fiji's total liability exceed the amount of fees paid by the customer to the platform in the 30 days prior to the incident (typically $0 as customers pay contractors directly).

Independent Contractor Relationship

All Tradespeople Are Independent Contractors:
  • Each tradesperson operates their own independent business
  • TradiesHub does not employ, supervise, or control any contractor
  • Contractors set their own rates, methods, and schedules
  • All work agreements are directly between customer and contractor
  • Payment flows directly from customer to contractor
  • Each contractor is responsible for their own licenses, insurance, and compliance
Customer Responsibility: You must independently verify contractor credentials, licenses, insurance, and qualifications before hiring.

User Responsibilities & Indemnification

Customer Responsibilities:
  • Verify contractor licenses, insurance, and qualifications
  • Obtain necessary permits and approvals
  • Ensure workplace safety compliance
  • Create written contracts with chosen contractors
  • Handle all payments directly with contractors
  • Report any platform misuse immediately
Contractor Responsibilities:
  • Maintain current licenses and certifications
  • Carry adequate insurance coverage
  • Comply with all applicable laws and regulations
  • Provide accurate profile information
  • Perform work to industry standards
  • Handle customer disputes professionally
INDEMNIFICATION CLAUSE

Users agree to indemnify and hold harmless TradiesHub Fiji from any claims, damages, losses, or expenses arising from their use of the platform or interactions with other users.

Dispute Resolution & Platform Limitations

Platform's Limited Role in Disputes:
  • TradiesHub may provide communication facilities but cannot resolve disputes
  • All work-related disputes must be resolved directly between parties
  • Legal disputes should be handled through proper legal channels
  • Platform may suspend accounts for serious violations
Recommended Dispute Prevention:
  • Always create detailed written contracts
  • Verify insurance coverage before work begins
  • Use milestone-based payments
  • Document all work progress with photos

Insurance & Licensing Requirements

IMPORTANT: Platform Does Not Verify Insurance or Licenses

While contractors may provide documentation, TradiesHub does not guarantee the validity, currency, or adequacy of any insurance or licensing.

Customer Must Independently Verify:
  • Current public liability insurance (minimum FJ$1M recommended)
  • Professional indemnity insurance where applicable
  • Valid trade licenses for regulated work
  • Workers' compensation coverage
  • Business registration and tax compliance

Governing Law & Jurisdiction

These terms are governed by the laws of the Republic of Fiji. Any legal disputes must be resolved in the courts of Fiji. Users consent to the exclusive jurisdiction of Fiji courts.

Severability:

If any provision of these terms is found unenforceable, the remaining provisions shall continue in full force.

Acceptance of Terms

By registering, browsing, or using TradiesHub Fiji, you confirm that you have read, understood, and agree to be bound by these terms of service and all associated policies.

Privacy Policy
